Holland Conservation Commission

Minutes of Commission meeting held on April 25, 2006.

Present: Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, Howard Fife, Rolf Hilbig and James Wettlaufer. Observer: Ann Hall Brady.

7:00 p.m. Chairperson called the meeting to order.

7:05 p.m. Minutes of Commission Meeting held on April 11, 2006 were read, accepted and will be distributed.
There was no meeting on April 18th due to Town Caucus.
Members signed vendor voucher paying the Republican $38.00 for Christopher Shackway’s Legal Ad; Staples: $9.98 for hanging folders.

Received in the mail:
1. DEP file # 184-0199 assigned to Michael Martino’s project at 27 Vinton Rd.
2. Peter Schartner’s Determination of Applicability.
3. From Richard A. Johnson, Service Forester/Director’s Agent several Forest Cutting Plans – locations being on Turnpike Rd., Brimfield Rd., Barney Rd., Dug Hill Rd., Stafford and Blodgett Rds., 80 Maybrook Rd., North Wales Rd. and Howlett Dr.

Peter Schartner’s project was discussed – suggestion made that we request that the contractor or engineer be present at his hearing.

7:30 p.m. Gordon and June Wiehler, neighbor John Day, Realtor Jack Reed and Mark Farrell, Green Hill Engineer were all present at the Public Hearing for the Wiehler’s project on 11 Island Rd., map R10-A19 DEP file #184-0198. Following Mark Farrell’s presentation, all parties agreed to close the hearing at 7:45 p.m. and approve the repair of the septic system as presented. Mark Farrell gave us a $50.00 check to pay for the Legal Ad/receipt given.

7:50 p.m. Victoria and Craig Steavola and Tom Keyser spoke of their concerns regarding the property on 9 Birch Dr. owned by Phil Miken – The fear is that the unstable condition of the foundation and house at 9 Birch Dr. threatens their property. They were informed that Phil Miken had on April 11th stated that he would appear tonight to address these concerns.

8:10 p.m. Procedure Sheet #2004-876 issued to Escape Estates Inc. was presented by David Smith to construct a single-family home with septic system and well at Lot 9, Butterworth Rd., Map 7C-2.09. Motion to accept the project was made and accepted by all. Mary vandenBerg signed the Procedure Sheet.

8:20 p.m. Michael and Cheryl Martino were present at their Public Hearing that was presented by Heather Blakeley of Trifone Engineers. A continuation of the Public Hearing to be held on May 2, 2006 at 8:30 p.m. is necessary because the abutter’s list has not been received.

8:40 p.m. Procedure Sheet #2005-G issued to JA and Elizabeth Scott of 12 Leno Rd. was presented by Robert Scott. He agreed to cut the trees near the house but to only prune the shoreline saplings. Mary vandenBerg signed the Procedure Sheet.

8:45 p.m. Procedure Sheet #2006-1064 issued to Peter Schartner of 44 Over-The-Top Rd., Map R15-B4. Having spoken with the Board of Health tonight, they suggested placing the tight tank nearer the road, which he agreed with. He will now speak to his engineer to revise and present us with an updated map at his hearing on 5-23-2006 at 7:30 p.m.

9:05 p.m. Jeff Flannery of 18 Craig Rd., Map R-21-A-10 having received approval by the Board of Health to install a septic system designed by Mark Farrell of Green Hill Engineer, hired Brian Kaitbenski to excavate. Mary vandenBerg received a phone call from Ann Hall Brady that she was concerned with the amount of dirt being taken and the clearing of the trees, causing an erosion problem for Craig Rd. and the lake. Mary vandenBerg alerted Jack Keogh, Zoning Enforcement Officer, who issued a Stop Work Order. We informed Mr. Flannery that he must put hay bails and silt fences in front of his property while this is investigated.

9:30 p.m. Procedure Sheet #2006-1049 issued to Joseph and Lisa Frigo of 12 Julie Ann Dr., Map R-31-D-18 to add a second floor to existing structure was presented by RJ Parron, contractor. Joseph Frigo and RJ Parron were informed that a Notice of Intent would be required due to the closeness of the waterfront and steepness of the property. A Public Hearing is scheduled for May 23, 2006 at 8:00 p.m.

9:55 p.m. A Request for Determination of Applicability was given to us by Mark Farrell of Green Hill Engineering for the proposed holding tank to be installed at 13 Massaconnic Tr., Map R-7-7.1 owned by Gerald Joyal. A Public Hearing is to be scheduled.

Motion to adjourn made by Rolf Hilbig, seconded and approved by all. Meeting adjourned at 10:00 p.m.
